FRESH OBSERVATION UNIPESSOAL LDA with its registered office at Rua do Hospital 8 – 3250-126 Alvaiázere and NIPC 517397471, hereinafter referred to as FOBS, is a commercial company whose object is the development and management of the mobile application “FURDESK“.

Within the scope of its activity, FOBS remotely collects personal data from its owners, ensuring that the respective processing is carried out in accordance with the privacy protection rules emerging from Regulation (EU) 2016/679 (“GDPR”) and other applicable national legislation, as well as in accordance with the confidentiality duties to which FOBS is subject.

The data collected corresponds to data provided by the owners themselves by filling in forms, by email, or by telephone, and also personal data resulting from these same relationships with the owners, including the use of FOBS’s digital channels accessed by the owner.

GUIDING PRINCIPLES

The main aim of this policy is to consolidate the relationship of trust and proximity between FOBS and its customers. It also aims to demonstrate transparency in the processing of data collected and to inform all customers of their rights and how they can exercise them as holders of personal data.

DEFINIÇÕES

  • FURDESK : Mobile application developed by FOBS.
  • PET SITTER: End User of the ‘FURDESK’ and direct customer of FOBS.
  • TUTOR(S): PET SITTER’s customer who, although they do not have direct access to the application, the latter is obliged to collect their consent prior to registering the personal data of their TUTORS in the application.

CONTROLLER

The entity responsible for processing personal data is FOBS insofar as it is responsible for determining the purposes and means of processing the data it holds.

DATA PROCESSED BY FURDESK

What is personal data? Personal data means any information of any nature, and regardless of its medium, relating to an identified or identifiable natural person. An identifiable person is one who can be identified directly or indirectly.

Who are the holders of personal data? The holders of personal data are Customers, Partners, Employees, as well as other natural persons to whom the data relates and who use FOBS’s services through its direct customers, the PET SITTERS, or their customers, the TUTORS.

What is personal data? They correspond to all the data necessary for the commercial relationship, namely: name, tax address, telephone number, e-mail address, and tax identification number.

PURPOSES OF PROCESSING

  • Registration management for TUTORS and their pets;
  • Appointment management;
  • Payment and Billing management;
  • Compliance with legal obligations;
  • Provide, operate, and improve the app’s features and functionalities;
  • Improve application security and protect against unauthorized access.

GROUNDS FOR DATA PROCESSING

FURDESK will only process personal data to the extent that the processing is lawful. This occurs under the following grounds:

  • Consent: When the subject has given express consent. In the case of TUTOR(S), the PET SITTER is responsible for ensuring consent.
  • Contractual Obligations: Necessary for the fulfillment of contracts or pre-contractual steps.
  • Legal Obligations: Compliance with judicial, tax, or regulatory requirements.
  • Legitimate Interest: To improve service quality, provided it does not override data protection rights.
  • Vital Interests: To protect the life of the subject or another natural person.

DATA COMMUNICATION AND SUBCONTRACTORS

FOBS does not sell, trade or rent personal information. Data is only shared with third-party providers (e.g., cloud storage, payments) necessary to operate the service or when required by law.

RETENTION PERIOD

Data is kept for as long as necessary for the established relationship or to comply with mandatory legal periods. When no longer needed, it is securely deleted or anonymized.

OWNERS’ RIGHTS

Data Subjects have the right to: Information, Access, Rectification, Erasure, Opposition, Portability, and Restriction of Processing. Subjects also have the right to lodge a complaint with the CNPD in Portugal.
