Terms & Conditions

These conditions are agreed between FRESH OBSERVATION UNIPESSOAL LDA, with registered office at Rua do Hospital 8 – 3250-126 Alvaiázere and NIPC 517397471, hereinafter referred to as “FOBS“, and the user of the mobile application “FURDESK” hereinafter referred to as “PET SITTER” and its customers, hereinafter referred to as “TUTOR” or “TUTORS“.

Both parties agree that all purchases shall be governed exclusively by this contract to the exclusion of any conditions previously available on this website.

ACCEPTANCE OF TERMS

By creating an account or using the application, PET SITTER agrees to comply with these Terms and Conditions and any other policies referred to herein (such as our Privacy Policy). These terms apply to any and all other individuals who may access or use the App.

PURPOSE

  • The purpose of these general terms and conditions is to define all information necessary for the PET SITTER regarding ordering, sales, payment, and service provision methods through the “Furdesk – Pet Care App”.
  • These conditions regulate all steps required to complete the purchase and guarantee the follow-up of service provision to the PET SITTER.

USER RESPONSIBILITIES

The PET SITTER is responsible for:

  • Managing TUTORS‘ data, including contact information and data relating to pets, appointments, and contracted services.
  • Maintaining the security and confidentiality of login credentials. Any activity carried out on your account will be deemed to have been carried out by you.
  • Providing accurate, complete, and up-to-date information.
  • Ensuring that misrepresentation or misuse of data does not occur.

USE OF THE APPLICATION

  • FOBS grants a non-exclusive, non-transferable, limited license to manage pet care services (dog walking, day care, grooming, etc.).
  • Some features require payment of fees. PET SITTER will be notified of charges in advance; failure to pay may result in termination of access to paid features.
  • Subscription schemes:
    • Unpaid/Free: Includes functional limitations.
    • Paid/Premium: No functional limitations.
  • PET SITTER may issue payment requests and invoices through integrations with external systems. Payment and invoice flows are not  FOBS‘s responsibility and must be verified in the integrated system.

PRICES (SUBSCRIPTIONS)

  • Prices are in Euros, including VAT in force on the date of payment.
  • Correct completion of invoicing data is the sole responsibility of the PET SITTER.
  • Once issued, an invoice cannot be reissued with changes.
  • Subscription payments are ensured by STRIPE.

PRICES (SERVICES)

  • Service prices are in Euros, including applicable taxes.
  • Correct completion of the TUTOR’s invoicing data is the sole responsibility of the PET SITTER.

CANCELLATION AND RETURN

The process of cancellation or return of a scheduled service is handled directly between the PET SITTER and the TUTOR, with no intervention from FOBS.

OWNERSHIP AND RESPONSIBILITY OF DATA

  • FOBS acts only as a management platform and does not claim ownership of customer data.
  • PET SITTER is responsible for obtaining customer consent to store data on the App in compliance with GDPR.

LIMITATION OF LIABILITY

The application is provided “as is”. FOBS disclaims liability for:

  • Data breaches resulting from user negligence.
  • Interruptions in application availability.
  • Unauthorized access to accounts due to credential misuse.

TERMINATION

We reserve the right to suspend or terminate accounts for violations of these Terms. Users may terminate their account at any time by contacting us.

APPLICABLE LAW

These Terms are governed by the laws of Portugal. Disputes shall be resolved exclusively by the courts in Lisbon.
